FINRA and SEC rules
SEC Rule 17a-4 requires firms to retain business communications for “no less than 3 years,” regardless of the “device or technology used to transmit the communication.” FINRA Regulatory Notice 24-09 confirms that these rules apply when firms use generative AI tools, including Claude.
FOIA and Sunshine Laws
When government employees use Claude for work, the prompts they enter and the responses they receive can be public records. Coverage is determined by the content and purpose of the conversation, not by the device or account used to access Claude.
HIPAA
