Jatheon Cloud Product Privacy Policy

1. Introduction
Jatheon Technologies Inc. (“Jatheon,” “we,” “us,” or “our”) is committed to protecting the privacy and security of personal data processed through Jatheon Cloud, our AWS-based communications archiving and compliance platform (the “Product”).
This Product Privacy Policy explains how Jatheon accesses, collects, uses, stores, protects, retains, and deletes personal data, including Google user data, when providing the Product to our customers. This policy applies solely to Jatheon Cloud and related services and supplements any applicable service agreements or data processing agreements.
Jatheon acts primarily as a data processor on behalf of its customers, who act as data controllers.
2. Information We Collect
2.1 Information Provided by Customers
The data processed by Jatheon Cloud is determined by our customers and may include information that users or administrators have provided, such as:
- Names
- Email addresses
- Phone numbers
- User IDs
- Message content and attachments
- Metadata associated with communications
- Administrative account details
This data is collected only as configured by the customer and in accordance with the applicable service agreement.
2.2 Google User Data
When authorized by a customer, Jatheon Cloud may access and process Google user data through Google APIs (such as Google Workspace APIs) strictly to provide archiving and compliance functionality.
Google user data processed may include:
- Gmail message content and attachments
- Email headers and metadata (sender, recipient, timestamps, subject lines)
- Google Workspace user identifiers
- Administrative configuration data required for service operation
Jatheon does not collect Google user data directly from individual end users for its own purposes.
3. How We Use Information
We use personal data, including Google user data, solely to provide and operate user-facing features of Jatheon Cloud, including:
- Capturing and archiving communications
- Indexing and searching archived data
- Supporting eDiscovery, legal hold, audit, and compliance workflows
- Maintaining system performance, reliability, and security
- Providing customer support and technical assistance
3.1 Prohibited Uses
Jatheon explicitly does not use Google user data for any of the following purposes:
- Targeted advertising
- User advertising of any kind
- Personalized, interest-based, or retargeted advertising
- Selling data to data brokers
- Providing data to information resellers
- Determining credit-worthiness
- Lending or financial profiling purposes
- Creating independent user databases
- Training machine learning or AI models
- Any purpose unrelated to providing or improving the Product’s user-facing features
4. Data Sharing, Transfer, and Disclosure
4.1 No Sale of Data
Jatheon does not sell Google user data or any personal data to third parties.
4.2 Limited Disclosure
We do not transfer or disclose Google user data to third parties except:
- To subprocessors (such as AWS) strictly for infrastructure and service delivery
- When required by law or valid legal process
- As explicitly authorized by the customer
All subprocessors are contractually bound by confidentiality, security, and data protection obligations.
4.3 Prohibited Transfers
Jatheon does not transfer Google user data for any of the following purposes:
- Targeted advertising
- Selling to data brokers
- Providing to information resellers
- Credit-worthiness assessment
- Lending purposes
- User advertisements
- Personalized, retargeted, or interest-based advertising
5. Data Security and Protection
Jatheon implements administrative, technical, and organizational safeguards to protect personal data and Google user data.
Security measures include:
- Encryption of data in transit and at rest
- Secure access controls and authentication mechanisms
- Role-based access restrictions
- Continuous monitoring and audit logging
- AWS security best practices and infrastructure protections
Security procedures are in place to protect the confidentiality, integrity, and availability of all data processed through the Product.
6. Data Storage and Hosting
All data processed by Jatheon Cloud is hosted within Amazon Web Services (AWS) infrastructure. Data residency and storage locations are governed by customer configuration and contractual agreements.
7. Data Retention and Deletion
7.1 Retention
We retain personal data, including Google user data, for a period of time that is consistent with:
- The customer’s configured retention policies
- The purposes outlined in this Privacy Policy
- Applicable legal, regulatory, or contractual requirements
7.2 Deletion
When the applicable retention period expires for a given type of data, or upon customer instruction:
- Data is securely deleted or destroyed
- Deletion is performed in accordance with industry-standard secure deletion practices
- Customers may request deletion of their data by contacting Jatheon Support or through administrative controls provided in the Product.
8. Customer and User Rights
As Jatheon acts as a data processor, requests relating to access, correction, or deletion of personal data should generally be directed to the customer (data controller). Jatheon will assist customers in fulfilling such requests as required by applicable law.
9. Compliance and Limited Use Commitment
Jatheon’s access to and use of Google user data complies with the Google API Services User Data Policy, including the Limited Use requirements.
Google user data is:
- Used only to provide or improve user-facing features
- Not used for advertising or profiling
- Not sold or shared for prohibited purposes
10. Changes to This Privacy Policy
We may update this Product Privacy Policy from time to time. Any changes will be posted on our Product and will become effective upon publication. Material changes will be communicated where required by law.
